Welcome to QualCare Academy LMS ("QualCare", "we", "our", or "us"). By accessing or using our services, you agree to these Terms of Use ("Terms"), which form a legally binding agreement between you and QualCare Academy.

These Terms cover your use of our websites, mobile applications, services, and learning tools (collectively, the “Services”). Whether you're a learner (“student”) or an educator (“instructor”), these Terms apply to all activities conducted through the QualCare platform.

1. Our Mission

QualCare Academy is dedicated to transforming healthcare in Africa by equipping professionals with high-impact, practical knowledge. We provide online courses, certifications, and continuous professional development (CPD) programs across healthcare disciplines.

2. Creating & Managing an Account

To access most Services, you must create an account using accurate and up-to-date information. You are solely responsible for your account and all activity under it. Sharing your login credentials is strictly prohibited.

Minimum age: You must be at least 18 years of age, or the age of digital consent in your country, to register.

3. Course Access & Use

When you enroll in a course, you receive a limited, non-transferable license to access the content for personal, non-commercial use only. This license may be revoked if:

  • Content is removed due to policy violations
  • You violate these Terms
  • Access is granted under a subscription that later ends

Course access does not give you rights to resell, distribute, or publicly share any content without written permission.

4. Payments, Refunds & Offers

4.1 Pricing

Course prices are set in Kenyan Shillings (KES) or other local currencies. Promotional or scholarship discounts may apply and are subject to change.

4.2 Payment Methods

You agree to pay course fees using a valid method (e.g., M-Pesa, card, or bank transfer). Non-payment may lead to access revocation.

4.3 Refund Policy

If you're not satisfied with a paid course, you may request a refund within 7 days of purchase. No refunds are given after this period unless the course is unavailable due to policy removal or technical fault on our part.

5. Instructor Terms

If you publish content on QualCare, you grant us the right to:

  • Distribute your content on our platform
  • Promote it across media (including social and print)
  • Collect and process student feedback

You retain full ownership of your intellectual property.

6. Code of Conduct

You agree to:

  • Post only lawful, respectful content
  • Not upload misleading, harmful, or plagiarized materials
  • Abide by CPD and accreditation requirements when applicable

Violations may result in account suspension or content removal.

7. Platform Rights & Ownership

QualCare owns the Services, platform, tools, and branding. You may not:

  • Reverse-engineer or reproduce our code or content
  • Use the platform for unauthorized commercial activity
  • Scrape, hack, or disrupt service access

8. Medical Content Disclaimer

Our platform provides healthcare education, not medical advice. Always consult a licensed professional before applying course knowledge in a clinical setting.

9. Limitation of Liability

QualCare shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Health outcomes resulting from misuse of content
  • Platform downtimes, content inaccuracies, or data losses

Your use of the Services is at your own risk.

10. Dispute Resolution

Any disputes shall first be resolved informally through our Support Team. If unresolved, disputes will be subject to Kenyan law and resolved in the courts of Nairobi, Kenya.

11. Privacy

Our handling of personal data is described in the QualCare Privacy Policy. By using our Services, you consent to our data practices.

12. Updates to These Terms

We may revise these Terms periodically. Significant changes will be communicated via email or platform notifications. Continued use of our Services after updates implies your acceptance.
